Difputes touching the reward, how to be determined.

and twenty three, any perfon or perfons whatsoever, wearing any vizard, mafk, or difguifed habit, or having his or their face or faces, or body or bodies difguifed, fhall within the faid place called Suffolk-place, or the Mint, or within any the limits, or pretended limits thereof, join in, or aid or abet any riot or tumult there, or fhall, in any vizard, mafk, or other disguise whatsoever, knowingly and willingly there oppofe the execution of any legal procefs, order or warrant, or affault and abuse any person or perfons ferving or executing any fuch process, order or warrant, or for having fo done, all and every fuch perfon and perfons, being lawfully convicted of any fuch offence, fhall be adjudged guilty of felony, and fhall forfeit and fuffer as in cafes of felony, without benefit of clergy; and all perfons aiding, affifting or abetting, or knowingly harbouring or concealing any fuch difguifed perfon or perfons, being thereof convicted, fhall be adjudged guilty of felony, and shall be transported to fome or one of his Majefty's colonies or plantations in America, by fuch ways, means and methods, and in fuch manner, and for fuch time, and under fuch pains and penalties, as felons in other cafes are by law to be transported. IV. And be it further enacted by the authority aforefaid, That from and after the tenth day of October one thousand seven hundred and twenty-three, all and every perfon and perfons, who shall apprehend and take any person or perfons, guilty of any of the offences before mentioned, and profecute fuch perfon or perfons until he or they be convicted, fhall have and receive, for every fuch offender fo convicted, the fum of forty pounds, to be paid by the theriff of the county of Surrey, without any deduction or fee for the fame, within one month after fuch conviction and demand thereof made, by tendring a certificate to the faid fheriff, under the hand or hands of the judge or juftices before whom fuch offender or offenders shall be convicted, certifying the conviction of such offender or offenders, and that he or they were taken by the perfon or perfons claiming the faid reward; and in cafe any difpute fhall arife between the perfons fo apprehending any of the faid offenders, touching their right and title to the faid reward, that then the faid judge or juftices, fo refpectively certifying as aforefaid, fhall in and by his and their faid certificate, direct and appoint the said reward to and amongst the parties claiming the fame, in fuch fhares and proportions, as to the faid judge or juftices fhall feem juft and reasonable; and if it fhall happen any fuch fheriff fhall die or be removed after fuch conviction and demand made of the faid reward (the same not being paid as aforesaid) that then the next fucceeding theriff of the faid county of Surrey fhall pay the fame, within one month after demand, and certificate brought as aforefaid; and if default of payment of the faid fum or fums of money fhall happen to be made by any fuch sheriff, the fheriff making default thall forfeit to the perfon and perfons, to whom fuch money fhall be due as aforefaid, double the fum or fums of money fuch theriff ought to have paid, to be reco

And be it further enacted, That in cafe any person or perfons fhall happen to be killed by any fuch offender or offenders, endeavouring to apprehend, or in making pursuit after him or them, that then the executors or adminiftrators, or The execufuch perfon or perfons, to whom the right of administration of tors, &c. of the perfonal eftate of each perfon fo killed fhall belong (upon perfons killed certificate delivered under the hands and feals of the judge or by offenders, juftices of affize for the county where the fact was done, or the 401. the two next juftices of the peace, of such person or perfons being fo killed, which certificate the faid judge or juftices, upon fufficient proof before him or them made, is and are hereby required immediately to give without fee or reward) fhall receive the fum of forty pounds from the fheriff of the county where the faid fact was done and committed, and upon failure of payment thereof by the faid fheriff, fuch sheriff fhall forfeit double the faid fum of forty pounds, to be recovered against him, with double cofts of fuit, in manner aforefaid.

VII. X. Provided always, That nothing in this act contained, fhall be conftrued to extend to repeal or make void the faid re8 & 9 W. 3. cited act of the eighth and ninth years of the reign of his faid c. 27. not relate majefty king William the third, or any other law in force, pealed by this against pretended privileged places, or for fuppreffing riots or tumults, but that the fame fhall, to all intents and purposes, be in full force and effect, as if this act had never been made, except in such cases touching which other provision is made by this act.

XI. And forafmuch as there may be inhabiting or refiding in the faid place called Suffolk-Place, or the Mint, or within the limits thereof, fome perfons, who by misfortunes in trade, or other accidents or calamities, have been reduced to fuch neceffities, as have obliged them to take Shelter or protection there; and it may be reasonable and convenient to give fome relief to fuch objects of charity and compassion, upon their faithful difcovering upon oath, and delivering up, and affigning all their eftates and effects whatsoever, for the benefit of their creditors, as is herein after directed; be it therefore enacted, &c.

Inhabitants of the Mint affigning over their effects, &c. are to be difcharged from arrefts, &c. Notice must be given thi ty days before the feffions to the creditors of the party petitioning to be difcharged. Clerk of the peace to give a duplicate of difcharge, on pain of 51. Inhabitants, &c. perjuring themselves, deemed felons. Perfons discharged are not to be imprisoned for debts due before the 11th of February 1722. General iffue pleadable. Others than the perfons difcharged by this act are answerable as before. No difcharge good, if not obtained before 10 July 1724. Bankrupts not intitled to the benefit of this act. Discharges fraudulently obtained, void. Petitioner, &c. to leave with the juftices a lift of his creditors, &c. perfons owing more than sol. &c. not to be difcharged. No helterer to gain a fettlement without paying to the poor, or ferving an office. EXP.

An att to enable lords of manors more easily to recover their fines, and to exempt infants and femes covert from forfeitures of their copybold eftates in particular cafes.

HEREAS fome doubts have arifen in the law concerning

I. tain called England, and the dominion of Wales, to feize the copyhold lands, tenements and hereditaments, parcel of their manors, on the neglect or refusal of perfons to come in, and be admitted tenants of the jame: therefore for afcertaining the law, and providing a reasonable and proper remedy for the lords of manors to compel the admiffion of their tenants; be it enacted by the King's moft excellent Majesty, by and with the advice and confent of the lords fpiritual and temporal and commons, in this present parliament affembled, and by the authority of the fame, That where any perfon or perfons, being under the age of one and twenty years, or feme or femes covert, thall from and after the twenty fourth day of June one thoufand feven hundred and twenty three, be entitled, by defcent or furrender to the ufe of a laft will, to be admitted tenant or tenants of any copyhold meffuages, lands, tenements or hereditaments, within that part of Great Britain called England, or the dominion of Wales, they the faid infants or femes covert, not having been admitted there- Feme coverts to, and not having paid their fines, every fuch infant or feme and infants may be admit covert, in their proper perfons, or fuch feme covert by her at- ted to copytorney, or such infant by his or her guardian or guardians, if hold eftates by he or the fhall have any fuch; and in case he or she shall have their attorney no guardian or guardians, then by his or her attorney or attor- or guardian. nies (for which purpofe fuch infants and femes covert fhall be and are hereby impowered, by writing under his or her hand and feal respectively, to appoint an attorney or attornies on his or her behalf) fhall come to, and appear at, one of the three next courts, which shall be kept (for the keeping whereof the ufual notice shall be given) for fuch manor or manors, whereof fuch meffuages, lands, tenements or hereditaments, fhall be parcel, and thall there tender and offer themselves to the lord, or his fteward of such courts, to be admitted tenants to all and every the faid meffuages, lands, tenements and herditaments fo furrendered, defcended or come to, or to the use of every fuch infant or feme covert; to make which appearance, and to take fuch admittance in behalf of fuch infant or feme covert, fuch guardian and attorney fhall be, and they are hereby respectively authorized and required: and in default of the appearance of fuch infants or femes covert, in their own perfons, or by their guardians or attornies in that behalf, and of acceptance of fuch admittance as aforefaid, it shall and may be lawful to and for the lord or lords of every fuch manor and manors, or his and their steward and stewards of the courts thereof, after such three feveral courts have been duly holden for fuch manor or manors, and proclamations in fuch feveral courts been regularly made,

to nominate and appoint at any fubfequent court or courts, to be holden for fuch manor or manors, any fit perfon to be guarIn default of dian or attorney for every fuch infant or feme covert for that their appear purpose only, and by fuch guardian or attorney, to admit every fuch infant or feme covert to all and every the faid meffuages, may appoint a guardian, &c. lands, tenements and hereditaments, according to fuch estates as fuch infants or femes covert fhall be legally entitled to therein; and upon every fuch admittance, to impofe and fet fuch fine and fines, as might have been legally imposed and set, if fuch infant fo admitted had been of full age, or if such feme covert had been fole and unmarried.

II. And be it further enacted by the authority aforefaid, That upon every fuch admittance or admittances of any infant or feme covert as aforefaid, the fine or fines impofed and fet thereupon, fhall and may be demanded by the bailiff or agent of the lord or lords of fuch manors, by a note in writing figned by the lord of fuch manor, or by his fteward, to be left with such infant or feme covert, or with the guardian of fuch infant, or husband of such feme covert, or with the tenant or occupier of the meffuages, lands or tenements, to which such infant or feme covert was admitted; and that if in such case the said fine or fines fo impofed and fet, be not paid or tendred to fuch lord or lords, or to his or their steward or ftewards, within three months after fuch demand made, that then it shall and may be lawful to and for the lord or lords of fuch manor or manors, where fuch admittance or admittances are had, to enter into and upon ail and every the copyhold meffuages, lands, tenements and hereditaments, to which any fuch infant or feme covert shall be fo admitted, and to hold and enjoy the fame, and to receive the rents, iffues and profits thereof, but without liberty to fell any timber ftanding thereon, for fo long time only and until by fuch rents, iffues and profits, fuch lord or lords, fhall be fully paid and fatisfied fuch fine and fines, together with all reafonable and necessary cofts and charges, which fuch lord or iords fhall have been put unto in levying and raifing the fame, and in obtaining the poffeffion of fuch copyhold meffuages, lands, tenements and hereditaments, although fuch infant or feme covert fhall happen to die before fuch fine and fines, and the costs and charges aforefaid, thall be raised and collected; of all which rents, iffues and profits, fo to be received by fuch lord or lords of fuch manor or manors, or his or their ftewards, bailiffs or fervants, upon the occafion aforefaid, fuch lord or lords of such manor or manors, fhall yearly and every year, upon demand to account year- be made by fuch perfon or perfons, who fhall be entitled to the ly. furplus of the rents and profits, over and above what will pay and fatisfy fuch fine and cofts and charges, fo received as aforefaid, or by fuch perfon or perfons, as fhall be then entitled to fuch copyhold eftate, give and render a juft and true account, and fhall pay the faid furplus rents, iffues and profits, if any, to fuch perfon and perfons, as fhall be refpectively intitled to the fame.
