VIII. And whereas, by the above-mentioned act, paffed in the thirty-first year of the reign of his late Majesty, the sum of fixpenca per diem was thereby directed to be allowed and paid to British governors, minifters, confuls, and merchants, refuding in foreign parts, for the fubfiftence of all feafaring men and boys, fubjects of Great Britain, that should be shipwrecked, captured, or by other unavoidable accidents be driven or cast away, or that should be discharged unserviceable from any ships or veffels of the royal nary, and the like sum of fixpence per diem was directed to be paid and allowed to every master or person having charge of a ship or vessel taking on board fuch feafaring mana, gd. per diem rected and al in the manner in the faid act mentioned; be it hereby enacted, That, to be allowed from and after the first day of August one thousand seven hundred in cafes where and ninety-two, the sum of nine-pence per diem shall be allowed 6d. was di- and paid in the stead of the aforesaid fum of fixpence; which feid lowed by fum of nine-pence per diem shall be paid in the fame manner, and 31Gco.2.c.ro. under the fame regulations and reftrictions, as are directed by the aforesaid at refpecting the fum of fixpence per diem thereby allowed, any thing to the contrary in any former act contained notwithstanding. The navy IX. And be it further enacted, That as soon as any petty offiboard to afcer or feaman, non-commiffioned officer of marines, or marine, fign for payment tickets who shall have been in any way discharged abroad, as aforefaid, prefented or shall present that part of the ticket or tickets which shall have tranfmitted to been delivered to him as herein-before directed, together with a them, &c. certificate of discharge in cafe he shall have been fent fick to any hofpital or fick quarters, and a ticket or certificate from the commander of any packet or trading ship or veffel, if he shall have fo arrived in any port in Great Britain, to the commiffioners of the navy, at their board, they shall examine, or cause the fame to be examined, by the muster books, or other returns for the time, if received; and, upon being duly fatisfied that the person so prefenting the fame is the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whose account the fame was made out, they, or any three of them, shall immediately affign for payment that part of fuch ticket or tickets which shall have been so presented to them by such petty officer or feaman, non-commiffioned officer of marines, or marine, or that part of the fame which shall have been transmitted to them by any captain or commanding officer in his Majesty's service, if fuch part shall have come to their hands, or either of fuch parts; and the part so affigned shall include the time that such petty officer or feaman, non-commiffioned officer of marines, or marine, upon whose account the same shall have been so made out, shall have been in any of his Majesty's foreign hospitals or fick quarters, in cafe he shall have been in any fuch hofpital or fick quarters, and of which he shall have produced certificates, as herein-before directed, from the agent of fuch hofpital or fick quarters, and also the time which fuch petty officer or feaman, non-commiffioned officer of marines, or marine, shall have been in any packet, or trading ship or veffiel, on his passage home, if he shall have fo come home, and of which he shall have produced certificates, as herein before directed, from the : affigned tick examine tick are to affign the commander of such packet, or trading ship or veffel; and the faid commiffioners having so assigned and otherwise completed such ticket, they shall immediately deliver, or cause the fame to be delivered to the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whose account the fame shall have been made out; who shall be entitled to receive payment Potty officers, thereon, and to remit what part thereof he may think proper, &c. entitled to with the fame powers, privileges, and restrictions as if the Laid Payment of wages were due at the general payment of any ship, provided he ets, &c. shall actually belong, at that time, to his Majesty's service, or shall have been duly and regularly discharged therefrom; and being fatisfied that such tickets or certificates were made out for and on account of the said person, he shall immediately tranfmit them to the commiffioners of the navy at their board, who shall cause the day upon which they shall receive the fame to be indorsed thereon, and shall examine, or cause them to be examined, by the muster books, or other returns for the time, if received; and they, or any three of them, shall assign for payment that part of fuch ticket or tickets which shall have been fo transmitted to them, or that part of the fame which shall have been tranfmitted to them by any captain or commanding officer in his Majesty's service, if such part shall have come to their hands, or either of such parts; and the part so assigned shall include the time that fuch petty officer or feaman, non-commiffioned officer of marines, or marine, upon whose account the fame shall have been so made out, shall have been in any of his Majesty's foreign hofpitals, or fick quarters, in cafe he shall have been in any such hofpital or fick quarters, and of which he shall have produced certificates as herein-before directed, from the agent of fuch foreign hofpital or fick quarters, and alfo the time which fuch petty officer or feaman, non-commifsioned officer of marines, or marine, shall have been in any packet or trading ship or vessel on his passage home, if he shall have fo come home, and of which he shall have produced certificates, as herein-before directed, from the commander of fuch packet, or trading ship or vellel, and the Tickets, fo faid commiffioners having fo affigned, or otherwise completed fuch aligned to he ticket, they shall immediately return, or cause the fame to be re-post for y turned to the commiffioner at fuch port who shall have tranf- men mitted the fame to them; and the faid commiffioner, upon receiving fuch ticket, shall immediately deliver, or cause the fame -to be delivered, to the petty officer or feaman, non-commiffioned officer of marines, or marine, upon whose account it fhall have L12 bcen returned tothe : : out lifts of the been made out, and shall direct payment to be made thereon without delay, and shall allow the said powers and privileges of remittance as aforesaid. Agents of hof- X. And be it further enacted by the authority aforesaid, That, pitals to make when and so often as any petty officers or feamen, non-commifpetty officers, fioned officers of marines, or marines, shall be sent sick to any &c. fent there, hospital or fick quarters at home or abroad, from any ship or which, when vessel in his Majesty's service, the agent of such hospital or fick figned as here- quarters shall make out or cause to be made out from the respec in directed, vouchers. tive fick tickets of fuch petty officers and seamen, non-commiffioned officers of marines, and marines, a lift containing their names, and the numbers at which they respectively stood upon the books of the ship or vefiel from which they shall have been fent; and the officer of such ship or veflel who shall have attended them on shore shall examine such lift, and finding the same to be just and true, shall date and fign the fame, and deliver it to the agent, who shall take the first opportunity thereafter to procure to the fame the fignature of the captain or commander of fuch ship or veffel, and which list shall remain with him, and be to him a sufficient voucher for having received such petty officers and feamen, non-commiffioned officers of marines, or marines, into such hospital or fick quarters, in lieu and instead of the fick ticket directed to be made out, fent, and delivered by the aforefaid act of the thirty-first year of the reign of his late Majesty. Petty officers, XI. And be it further enacted, That when and so often as any &c. returning petty officer or feaman, non-commiffioned officer of marines, or to their ships from hofpitals marine, shall be fent fick to any hofpital or fick quarters at home to leave their or abroad, and shall afterwards be discharged therefrom to return to the ship from which he shall have so been fent, he shall leave his fick ticket in the hands of the agent of fuch hospital or fick quarters, who shall tranfmit the fame to the commiffioners of the fick tickets with the agents, &c. but if they are navy, with their monthly or quarterly returns; but if fuch petty difcharged as &c. officer or seaman, non-commissioned officer of marines, or marine, shall be difcharged unserviceable from such hospital or fick quarany othership, ters, or be discharged therefrom to serve in any other ship or to keep them, vessel, he shall keep and preserve such ticket for payment: provided always, that if such petty officer or seaman, non-commiffioned officer of marines, or marine, thall be so discharged to ferve in any other ship or vefiel, such ticket shall not be payable until the ship on board of which he shall go from such hospital or fick quarters shall come in course of payment, or until he shall be in any way difcharged therefrom. Petty officers, hofpitals, &c Bri XII. And be it further enacted, That any fuch petty officer or feaman, non-commiffioned officer of marines, or marine, who shall be so fent fick from any ship or vessel into any of his Ma tain to be al- josty's hospitals or fick quarters in Great Britain, shall not be allowed wages or pay for more than thirty days of the time which he shall remain in such hospital or fick quarters. lowed only XIII. And be it further enacted, That if any petty officer or Petty officers, -feaman, non-commissioned officer of marines, or marine, shall &c discharghave been duly discharged, as difabled or unserviceable, from his ed as unfership, or be discharged as disabled or unserviceable from any of his hofpitals, be - Majesty's hofpitals or fick quarters, at home or abroad, and shall ing at ports - arrive or be at any port in Great Britain where no commissioner where no of the commiflioner shall be navy or refide, and shall at such port, or at any of the navy reother place in Great Britain, be defirous to receive payment of fides, and any ticket or tickets, certificate or certificates, which shall have withing to rebeen made out on his account as herein-before directed, and for ceive payment any time when such petty officer or feaman, non-commiffioned of tickets, to apply to the officer of marines, or marine, shall have been upon his passage collectors of home, after having been difcharged from such ship, or from such the cuftoms, hospital or fick quarters, he shall apply to the collector of the &c. customs, collector of the excife, or receiver-general of the land tax, or clerk of the check, who may be at or nearest to fuch port or other place in Great Britain, and shall present and deliver to him such ticket or tickets, together with the certificate of his having been duly discharged from fuch ship, or fuch hospital or fick quarters, as the cafe may be, and likewise (if he has received no wages or other confideration for his services in any packet or trading ship or vessel on board of which he may have arrived in Great Britain), a certificate thereof from the master or commander of fuch packet or trading ship or vessel; and fuch collec- Collectors. tor of the customs, collector of the excife, receiver general of the &c. on fuch land tax, or clerk of the check, in Great Britain, to whom he application to may apply respectively, is hereby required and directed to receive identity of the such tickets and certificates, and to require certificate from the party, and master of the packet or vessel in which such seaman shall have tranfmit tick come home, if he shall have so come home, or from some re- ets, &c, to the navy, board, putable inhabitant of fuch place, that he knows the perfon apply- &c. ing to him as aforesaid, or believes such person to be the party entitled to hold the tickets or certificates which he thall have fo presented, and whose address they shall also specify; and the faid collector of the customs, collector of the excife, receiver general of the land tax, or clerk of the check, as the cafe may be, being fatisfied L13 a afcertain the i Tickets fo be examined, fatisfied in every respect with regard to the identity of fuch petty officer or feaman, non-commiffioned officer of marines, or ma rine, shall grant grant an acknowledgement or receipt to him for fuch tickets and certificates as he shall so deliver, and shall immedi ately tranfmit the fame, together with the certificate, and party's address, taken by him as before directed, addressed to the commiffioners of his Majesty's navy, at their board in London, who shall cause the day upon which they shall receive the fame to be tranfmitted, to indorfed thereon, and they shall immediately cause such ticket or andremittance tickets, and certificate or certificates to be examined by the muibills made out ter books, if received, and shall make or cause to be made out, for the time, within three days, a remittance bill for the net balance due upon &c. fice, &c. fuch tickets and such certificates, or upon the ship's books for which such ticket or tickets shall have been made out, in cale the ship or ships shall have been paid for the time, and which re mittance bills they are hereby directed and required to make out, allign, attest, forward, and tranfinit, in the manner herein-before directed in cases of foreign remittances, and which remittance bill for payment shall be made payable only to such petty officer or feaman, non-commiffioned officer of marines, or marine, to whom fuch wages shall be due; and such remittance bills shan be made out in the form herein-before directed, in cafes of parties defiring their wages to be remitted from abroad, or to the like effect. XV. Provided always, and be it further enacted and declared Other tickets by the authority aforesaid, That in cafe both parts of any fuch remay be made move ticket, herein before directed to be granted and delivered to for those lost, fuch petty officer or feaman, non-commiffioned officer of marines, on application to the navy of. or marine, and to be tranfmitted to the commiffioners of the navy as aforefaid, or that part of fuch ticket which shall contain the certificate et discharge herein before directed to be granted by the agents of his Majesty's hofpitals or fick quarters, shall happen to be loft or destroyed before the ship or veffel thall be paid for the time for which fuch ticket shall have been made out, then, and in any fuch cafe, another ticket or other tickets, or another certificate or other certificates, shall, upon application to the commillioners of the navy, (upon their being fatisfied of the identity: of the party), be immediately made out from the muster books and hofpital returns refpectively if received, and which other ticket or tickets, certificate or certificates, shall be to fuch petty officer of feaman, non-commiffioned officer of marines, or marine, in every refpect the fame as the ticket or tickets, and certificate or certifi cates, which were so loft or destroyed; and provided also, that in cale any petty officer or feaman, non-commiffioned officer of marines, or marine, to whom such ticket or tickets, and certifcate or certificates, shall have been made out, shall not appear in perfon and present the fame, in order to obtain payment as aforefaid, before the ship or vessel shall be paid for the time for which fuch ticket or tickets shall have been made out, then, and in every fuch case, the pay or wages due to fuch petty officer of feaman, non commissioned officer of marines, or marine, for fuch Such tickets funted betere the thip be paid, &c. |
