furnish assistance to an airport operator, or any air

carrier, intrastate air carrier, or foreign air carrier engaged in air transportation or intrastate air transportation to carry out the purposes of the air transportation

security program.

"OVERALL RESPONSIBILITY

"(c) Except as otherwise expressly provided by law, 8 the responsibility for the administration of the air trans9 portation security program, and security force functions 10 specifically set forth in this section, shall be vested exclu11 sively in the Administrator of the Federal Aviation Admin12 istration and shall not be assigned or transferred to any other 13 department or agency."

SEC. 25. Section 1111 of the Federal Aviation Act of

15 1958 is amended to read as follows:

"AUTHORITY TO REFUSE TRANSPORTATION

"(a) The Administrator shall, by regulation, require

18 any air carrier, intrastate air carrier, or foreign air carrier

19 to refuse to transport—

"(1) any person who does not consent to a search

of his person to determine whether he is unlawfully

carrying a dangerous weapon, explosive, or other destructive substance, or

"(2) any property of any person who does not

consent to a search or inspection of such property to

determine whether it unlawfully contains a dangerous weapon, explosive, or other destructive substance;

4 Subject to reasonable rules and regulations prescribed by 5 the Administrator, any such carrier may also refuse trans6 portation of a passenger or property when, in the opinion 7 of the carrier, such transportation would or might be inimical 8 to safety of flight.

9 "(b) Any agreement for the carriage of persons or 10 property in air transportation or intrastate air transportation 11 by an air carrier, intrastate air carrier, or foreign air carrier 12 for compensation or hire shall be deemed to include an agree13 ment that such carriage shall be refused when consent to 14 search persons or inspect such property for the purposes 15 enumerated in subsection (a) of this section is not given." SEC. 26. Section 902 (1) of the Federal Aviation Act

17 of 1958 is amended to read as follows:

"CARRYING WEAPONS ABOARD AIRCRAFT

"(1) (1) Whoever, while aboard, or while attempting to 20 board, any aircraft in or intended for operation in air trans21 portation or intrastate air transportation, has on or about 22 his person or his property a concealed deadly or dangerous 23 weapon, explosive, or other destructive substance, or has 24 placed, attempted to place, or attempted to have placed 25 aboard such aircraft any property containing a concealed

1 deadly or dangerous weapon, explosive, or other destructive 2 substance, shall be fined not more than $1,000 or imprisoned 3 not more than one year, or both.

4 "(2) Whoever willfully and without regard for the 5 safety of human life or with reckless disregard for the 6 safety of human life, while aboard, or while attempting to 7 board, any aircraft in or intended for operation in air trans8 portation or intrastate air transportation, has on or about his 9 person or his property a concealed deadly or dangerous 10 weapon, explosive, or other destructive substance, or has 11 placed, attempted to place, or attempted to have placed 12 aboard such aircraft any property containing a concealed 13 deadly or dangerous weapon, explosive, or other destructive 14 substance shall be fined not more than $5,000 or imprisoned 15 not more than five years, or both.

16 "(3) This subsection shall not apply to law enforcement 17 officers of any municipal or State government, or the Fed18 eral Government, while acting within their official capacities 19 and who are authorized or required within their official 20 capacities, to carry arms, or to persons who may be au21 thorized, under regulations issued by the Administrator, to 22 carry concealed deadly or dangerous weapons in air trans23 portation or intrastate air transportation."

24 SEC. 27. To establish, administer, and maintain the air 25 transportation security force provided in section 316 of

the Federal Aviation Act of 1958, there is hereby author2 ized to be appropriated for fiscal year 1973 the sum of 3 $35,000,000, and for each succeeding fiscal year such 4 amounts, not to exceed $35,000,000, as are necessary to 5 carry out the purpose of such section.

SEC. 28. Section 101 of the Federal Aviation Act of 7 1958, as amended, is amended by adding after paragraph

8 (21) the following:

"(22) 'Intrastate air carrier' means any citizen of the United States who undertakes, whether directly or indirectly or by a lease or any other arrangement, solely to engage in intrastate air transportation.

"(23) 'Intrastate air transportation' means the carriage of persons or property as a common carrier for compensation or hire, by turbojet-powered aircraft capable of carrying thirty or more persons, wholly within the same State of the United States."

18 and is further amended by redesignating paragraph (22) as 19 paragraph (24) and redesignating the remaining paragraphs 20 accordingly.

SEC. 29. That portion of the table of contents contained

22 in the first section of the Federal Aviation Act of 1958

23 which appears under the heading:

“TITLE III-ORGANIZATION OF AGENCY AND POWERS AND DUTIES OF ADMINISTRATOR"

1 is amended by adding at the end thereof the following:

"Sec. 315. Screening of passengers in air transportation. "Sec. 316. Air transportation security force.

“(a) Powers and responsibilities.

"(b) Training and assistance.
"(c) Overall responsibility.”.
