An Act in addition to a Law of this State, entitled, an Act for constituting and regulating Courts, and appointing the Times and Places for holding the fame. BE it enacted by the Governor, Council and Representatives in General Court affembled, and by the Authority of the fame, That for the future, the Times and Places of holding the County Courts in the County of Middlesex, shall be as follows, viz. at Middletown on the second Tuesday of November annually, and at Haddam on the first Tuesday of April annually; and that any adjourned or Special County Court may be holden at fuch Times and Place within either of faid Towns in faid County, as faid County Court fhall order and determine; any Law, Ufage or Cuftom to the contrary notwithstanding. E it enacted by the Governor, Council and Representatives, in General Stratford Ferry shall be as follows, to wit, For a fingle Man One-penny half-penny, for a Man, Horfe and Load Three-pence, for a lead Horfe Twopence, for an Oxor any other Neat Kine Four-pence, for every two wheeled Carriage with one Man and a draft Horfe Six-pence, for every tour wheeled Carriage, one Man and a draft Horfe Nine-pence, and for every additional Perfon or Horfe, or other Beaft, the fame as is afore ftated in like Cates, and for a Goat, Swine, or Sheep, Three-farthings. An 354 40s. per acre to be deducted from the lift for land fowed with hemp. Lifters to Hemp. Fisheries. An Act for the Encouragement of the raising of Hemp. BE it enacted by the Governor, Council, and Reprefentatives in General Court affembled, and by the Authority of the fame, That all Perfons in this State may annually during the continuance of this Act, infert in their several Lifts of Polls and rateable Eftate given in to the Lifters of the refpective Towns to which fuch Perfons belong, an Account of the Quantity of Land which they fhall have feverally fowed with Hemp, in the Seafon next preceeding the giving in fuch Lift, and thereupon faid Lifters in making up the Lifts of Eftate as aforefaid, fhall credit and deduct from the Sum total of the Lift of fuch Perfons refpectively, at the rate of Forty Shillings per Acre for any Quantity of Land fowed with Hemp and inferted in the Lift as aforefaid. And be it further enacted, That if fuch Lifters by inspecting the Lifts of rateable Estate as the Law directs, fhall find that any Perfon or Perfons have inferted in their Lifts, any greater Quantity of Land to have fourfold, &c. been fown with Hemp than was actually fowed with Hemp, it fhall be the Duty of fuch Lifters, to add to the Lift of fuch Perfon or Perfons Fourfold the Sum deducted as aforefaid. Land ex And be it further enacted by the Authority aforefaid, That all Land fowempted from ed with Hemp in the Seafon next preceeding the giving in the Lift of rateable Eftate, fhall be exempted from fuch Lifts. the lift. Duty on imported hemp and cordage. Provifo. Continuance. Duty of 35. per quintal on fith imported. Provifo. And it is further enacted by the Authority aforefaid, That a Duty of Six Shillings fhall be paid on each Hundred Weight of Hemp or Cordage imported into this State by Land or Water, from and after the firft Day of May A. D. 1789; which Duties fhall be collected and paid in the fame Manner as is already by Law provided for the Collection and Payment of Duties on other imported Articles. Provided, That nothing in this Act fhall extend to the Growth or Manufacture of the United States. And it is further enacted, That this A&t fhall continue in Force for the Term of Seven Years from the rifing of this Affembly, and no longer. An Act in addition to an Act, entitled, an Act for encouraging and regulating Fisheries. BE it enacted by the Governor, Council, and Representatives in General Court affembled, and by the Authority of the fame, That for the future there fhall be a Duty of Three Shillings Lawful Money on each Barrel or Quintal of Fish, which fhall be imported or fold within this State, not caught by fome of the Subjects of this, or the United States; and that the Monies arifing thereon, be appropriated towards the fupport of civil Government; to be collected in the fame Manner, and under the fame Penalties, as Goods, Wares, and Merchandize imported into this State by. Land or Water. And it is further enacted, That when any Queftion fhall arife pursuant to the Provifions of this Act, by whom fuch Fifh were caught, the burthen of Proof fhall lye on the Importer thereof. Executions. TENSIS ILL 355 ACTS and LAWS, Made and paffed by the General Court or An Act impowering Judges of the Court of Common tions in certain Cafes. BE Incafes where sheriffs receive & levy thetreafurer's executions on eftates of in habitants of towns in arrears, & take it enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the fame, That in all Cases, where the Sheriffs of the feveral Counties in this State, fhall receive Executions from the Treasurer, against the Inhabitants of any Towns, for the Arrears of public Taxes, and levy the fame on the Eftate of fuch Inhabitants, or any Part of them, and take their Receipts for fuch Eftate, to be delivered at the Place of Sale, according to Law; and on failure of the Delivery of fuch Estate, shall obtain Judgment and Execution there on against the Inhabitants of fuch Towns, or any Part of them; that then the Judges of the Court of Common Pleas in each County, may, at the Request of the Sheriffs, depute and impower fome fuitable and indifferent Perfon to ferve and return fuch Executions; which Perfons deputed as aforefaid, fhall have the fame Power and Authority in ferving pleas to apfuch Executions as Sheriffs and Conftables have by Law. And the She-point fomeoriffs fhall be refponfible for any Neglect or Default of every Perfon deputed at their Requests, as aforefaid, in the fame Manner as they are for their Deputies. And be it further enacted by the Authority aforefaid, That in all Cafes where Sheriffs have already obtained Executions against the Inhabitants of any Towns, or any Part of them in the Manner aforefaid, the Judges of the Court of Common Pleas in each County, may depute fome Perfon to ferve the fame as aforefaid. An Act in Addition to an Act, entitled, An Act for conftituting Judges and Juftices of the Peace in this State, and for impowering and directing them in their respective Offices. E it enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the fame, That the Judges of County Courts, and Juftices of the Quorum refpectively, fhall have Authority, and Authority is hereby granted them, to iffue Procefs, returnable to the Courts to which they refpectively belong, in all Civil Matters to be ferved in any Part of this State. An Act in Alteration to an Act, entitled, An Act for regulating Fees, &c. E it enacted by the Governor, Council, and Representatives, in General Court affembled, and by the Authority of the fame, That for the future the Fees to Naval-Officers for the Clearance of a coafting Veffel, bound either to the State of New-York or Rhode-Ifland, under the Burthen of Twenty Tons, Carpenter's Tonnage, fhall be Three Shillings. No town lia ble to the collector of rates for inhabitants committed to Be it further enacted by the Authority aforefaid, That the Mafters of all Veffels who fhall neglect to clear out their Veffels according to Law, fhall incur a Forfeiture of Forty Shillings Lawful Money for every fuch Neglect; one Moiety thereof to the Treafury of this State, and the other Moiety to him who fhall complain and profecute the fame to Effect; to be heard and determined by any one Affiftant or Juftice of the Peace, from whofe Judgment therein no Appeal fhall be allowed. An A&t in Addition to a Law of this State, entitled, BE E it enacted by the Governor, Council, and Representatives, in General Court affembled, and by the Authority of the fame, That no Town shall be chargeable with, or liable to the Collector for any of the Rates of the Inhabitants of fuch Town, who fhall be committed to Goal therefor by fuch Collector, or the Coft and Charges occafioned by fuch Commitment; nor fhall the Treasurer iffue an Execution in Favour of fuch Collector against the Select-Men of fuch Town, unlefs fuch Commitgoal, unlefs, ment be made within eight Months from and after fuch Rates become due and payable: Any Thing in faid Act to the contrary notwithstanding. Am An Act in Explanation of a Law of this State, entitled, An Act for collecting and paying Rates and Taxes. HEREAS it is provided in faid Alt, "That if fuch Collector shall WHE 357 "deliver up his Rate Bill into the Hands of the Select-Men, they Preamble. are hereby impowered to depute fome meet Perfon to collect what "remains uncollected thereon, and the fame fhall be accounted for in Favour of faid Collector." In the Construction of which Paragraph a Doubt has arifen, whether any Perfon, deputed as aforefaid, becomes thereby vefted with Power to levy any Warrant for the Collection of fuch Taxes: And the Collection of Taxes has thereby, in fome Inftances, been much delayed and obftructed. Be it therefore enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the fame, That in all Cafes where any Perfon or Perfons heretofore have been, or hereafter shall be deputed by the Select-Men of any Town, agreeably to the Provifion of faid Act, fuch Perfon or Perfons, deputed as aforefaid, does and fhall thereby become fully, and in all Refpects vefted with the fame Rights, Powers, and Authorities, to all Intents and Purposes whatsoever, and is and shall be at all Times under the fame Regulations as fuch Collector fo delivering up his Rate Bill, as aforefaid, was before invested with. An Act in Addition to an Act, entitled, An Act for ordering and regulating Fields and Fences. E it enacted by the Governor, Council, and Representatives, in General Owners and adjoining Proprietors of Land in any common Field, fhall fence and improve any particular Fields or Inclofures in feveralty within fuch common Field, fuch Owners or adjoining Proprietors fhall make and maintain a fufficient dividend Fence equally between them, (that is to fay) one of them the one Half, and the other of them the other Half thereof: Which dividend Fence fhall be made agreeable to the Directions of faid Act refpecting what fhall be deemed fufficient Fence to fecure particular Fields or Inclosures not within a common Field; and fhall be under the fame Regulations and Provifions in faid Act, as is made for preventing Difputes about fencing particular Inclosures, and rendering the Improvement of them profitable to the Owners.
